1. General Conditions

a. Eligibility: By placing an order, you confirm you are at least 18 years old or are placing the order with the consent of a parent or guardian. b. Accuracy: We reserve the right to correct any errors, inaccuracies, or omissions on the website (including pricing, product descriptions, and availability) and to change or update information at any time without prior notice. c. Service Refusal: We reserve the right to refuse service or cancel orders at our sole discretion, including but not limited to situations where a product is no longer available or there is suspicion of fraudulent activity.

2. Ordering, Payment, and Cancellation

a. Pricing: All prices are listed in US Dollars (USD) and are subject to change without notice. The price charged will be the price in effect at the time the order is placed. b. Payment: Full payment is required at the time of placing an online order. Payment is processed securely by third-party payment processors (e.g., Stripe, PayPal). We do not store your full credit card information. c. Order Customization: You are responsible for accurately entering all order details, including flavors, personalization messages, dates, and times. We are not liable for issues arising from customer input errors. d. Cancellation Policy: Since we begin sourcing and scheduling production shortly after an order is placed: * Cancellations requested 48 hours or more before the scheduled pickup/ship date will receive a full refund. * Cancellations requested less than 48 hours before the scheduled pickup/ship date are not eligible for a refund as ingredients and time slots have already been allocated.

3. Local Pickup and Shipping

a. Local Pickup: For all local pickup orders, you must arrive within the agreed-upon time window. If you fail to pick up your order on the scheduled date, it will be forfeited, and you will not be eligible for a refund, as the baked goods are perishable. b. Shipping (If Applicable): If you choose to have an order shipped, we will package it securely. However, once the order leaves our premises and is in the care of the shipping carrier (USPS, UPS, etc.), the risk of loss or damage passes to you. We are not responsible for delays, damage, or theft that occurs during transit and cannot issue refunds or replacements in these circumstances.

4. No Refund and Return Policy (Perishables)

a. All Sales are Final: Due to the perishable and custom nature of our products, all sales are final, and we do not accept returns or offer refunds. b. Quality Exception: If there is a demonstrable error on our part (e.g., an incorrect flavor or item was prepared), you must notify us within 24 hours of pickup/delivery with photographic evidence. We reserve the right to offer a store credit or replacement at our sole discretion.

5. Allergens and Product Safety

a. Allergen Disclaimer: Our products are baked in a home kitchen that handles major allergens, including but not limited to wheat, eggs, dairy, peanuts, and tree nuts. We cannot guarantee any item is 100% free of trace amounts of these allergens. By purchasing, you acknowledge this risk and agree that Touch Of Love Bakery is not responsible for any adverse allergic reactions. b. Handling: Once the product is accepted by you or a designated agent, you assume all responsibility for its proper storage and transportation. We are not liable for damage or spoilage that occurs after the product has left our possession.

6. Texas Cottage Food Law Disclosure

As a Texas Cottage Food Operation:

THIS PRODUCT WAS PRODUCED IN A PRIVATE RESIDENCE THAT IS NOT SUBJECT TO GOVERNMENTAL LICENSING OR INSPECTION.
